Any accusation of grand theft should be addressed immediately and taken extremely seriously. In the State of California, a grand theft charge may be a misdemeanor or felony offense, depending upon the circumstances. Although grand theft is typically a crime in which a person steals at least $400 or $400 worth of goods, there are many other crimes which constitute grand theft. The following are crimes that, in California, are considered grand theft:

  • Stealing livestock, such as mules, pigs, or sheep
  • Stealing firearms
  • Stealing money from an employer, totally over $400 within a period of one year
  • Stealing a dog which is worth more than $400
  • Stealing certain food items that total over $100, such as avocados, nuts, and citrus fruits
  • Stealing a motor vehicle
  • Stealing over $100 worth of fish from a store or research facility

Penalties for grand theft can be severe, especially for thefts of money or items worth more than $50,000. California Penal Code section 489. describes the following as punishments for grand theft crimes:

"(a) When the grand theft involves the theft of a firearm, (it is punishable) by imprisonment in the state prison for 16 months, 2, or 3 years.

(b) In all other cases, (it is punishable) by imprisonment in a county jail not exceeding one year or in the state prison."

If you are arrested for grand theft in California, you may have to serve a term in jail or state prison. This can be a devastating experience for you as well as your loved ones. The grand theft defense attorneys at McGregor & Ernenwein will work diligently to have your grand theft charges dropped or your sentence reduced.
